November 6th, 2026 – The UK's Porn Laws Are Changing!
From 6 November, new laws in England and Wales will make it a criminal offence to possess or publish certain types of pornography, even where the people depicted consented.
Under the Crime and Policing Act 2026, the restrictions cover explicit and realistic depictions of strangulation or suffocation, certain incest-themed pornography, and sexual activity involving people portrayed as under 16.
But how far do these laws go? Could people face prison for videos they've already downloaded? What happens to content creators, OnlyFans accounts and adult websites?
In this episode, we break down what's changing, the potential penalties, and the debate around personal freedom, consent, censorship and protecting people from harm.
Is this necessary protection, or are the laws going too far?
Join the discussion and have your say.

Hello! Today we are going to be speaking about the changes in laws which will be happening on the 6th of November this year. From the 6th of November it will be a criminal offence in England and Wales to possess or publish pornographic images that explicitly and realistically depict strangulation or suffocation penetrative sexual activity between people who a reasonable person would think are related or pretending to be related in a certain way. This includes depictations of close family relatives, such as father and daughter or brother and sister, and certain step and foster relationships where one person is or pretending to be under eighteen. Sexual activity between at least two people where a reasonable person would think at least one person is or is pretending to be under sixteen. The offences only capture pornography that shows people which appear to a reasonable person to be real. So this is what the UK government are implementing on the 6th of November. I'm honestly really surprised that there wasn't any protests or anything like that because this it's a lot. It's a lot, trust me, we're gonna get really into it. It's a lot of stuff which they've banned. And it's really shocking. So what I'm I've just read and what I'm going to read is from the um government website. So you can see what the government have said and then we're gonna talk about well how it's affected sex workers massively, and not not not just the guy who will be wanking off every so often. This it already has taken effect, which is so crazy, it really is. I'm also writing a workshop currently, which I will be running in middle of January and end of February, well start of February next year in 2027. Crazy to think the year's almost out as well, about just sex work 101. If people want to start sex work or think about doing it or know somebody who does it and wants to learn more or already does it, then that's the workshop which I'm doing, and I will be talking a little bit about the laws and things like that, and oh man, this it's not just people who have produced porn with like creators, it's also like photographers, um video editors and things like that in the UK. So before I go on a little rant, the government this is on the government website, the government recognises the harm that some forms of pornography can have in real shaping world behaviour, including by normalizing harmful or illegal sexual behaviour. That is why it has criminalized the possession and publication of particularly harmful forms of pornography, including material depicting strangulation or suffocation, sex between certain relatives, i.e. incest porn, and adults role-playing as children under 16. These offences tackle pornography that risks normalizing conduct that is harmful or illegal in real life, such as child sexual abuse. So, personally, I think this is just a freaking band-aid, honestly. They are doing the minimum, I want to say the government to try and get rid of CSAM, child pornography. They have already admitted the online safety act has not worked, and if they could revert it, they would, which is insane. I have done two podcast episodes on the online safety act. I definitely would encourage you to go look at it. It is another just blanket ban the UK has set, and again, it has impacted sex workers quite heavily. It's like the UK is becoming like I would say like the stereotypical like Christian nation where we're not gonna talk about sex, we're not gonna hear it, we're not gonna buy it, we're not gonna see it. It's ridiculous. It really is. So, yeah, from the 6th of November, it will be a criminal offence in England and Wales. Weirdly not Scotland. They haven't mentioned Scotland to possess or publish pornographic images that explicitly and realistically depict as I've mentioned, you know, stranglation, suffocation, age play. It honestly's so confusing because there's not enough behind it, but for whatever reason, this past. Like, does it include age play? What about posting on things like Fet Life? What what does that mean? It's really honestly quite irresponsible in the way the government just goes, Oh yeah, we're gonna ban this, but we're not really gonna explain everything that you can do and potentially get in trouble for or not get in trouble for. And it's just we need answers. That's the big main thing. The offences only capture pornography that shows people which appear to be, you know, a reasonable person to be real. The maximum penalty for possession, this is on the government website, two years imprisonment for pornography that depicts strangulation or suffocation, or penetrative sexual activity between certain relatives. Three years imprisonment for pornography depicting sexual activity involving a person who is or pretending to be under 16. Now also the maximum penalty for publication for all offences is five years imprisonment. Now I'm not being funny, but men can wank to anything. Men can make anything into porn. This is just so unbelievable that if you look under the age of 16 you might get in trouble. Right. There's also a defence where the person who possesses or publishes the image directly participated in the act shown in the image and other criteria are met. For the possession offences, there's also a defence where a person was sent the image without asking for it, either themselves or through a third party, and did not keep it for an unreasonable length of time. The offences also attract a defence of legitimate reason for possessing or publishing the image. Like, porn's not a good enough reason. Like, oh, I wanted to post this because it makes me income. That's not a good reason. Even though we get taxed out of our asses because they have just increased income tax. Uh doesn't matter. Doesn't matter. If you're trying to survive in an economy like this by selling pictures and whatnot. Like what we mean by possession and publication, the term possess is not defined in the legislation and will be given its ordinary meaning. Whether a person possesses an image will be a question of fact for the court in each case. So that means if you do get caught with something, you will have to go to court, and that's the only way of it getting like thrown out or whatnot. You have to take it that far. And bear in mind in the UK there's still a backlog in the court system. So the police would have 18 months to give you like a summons to go to court in the first place, and if they don't give you that summons within 18 months, they have to then reinvestigate everything again. Um and then if they like they might dismiss it if it comes close to the 18 months. That's what happened with my case, which was a bit different. Um, I was suspected of running a brothel because remember in the UK you cannot work with another sex worker even if you're not working at the same time. It if you're working out at the same property, it's against the law and it's classed as a brothel. We've got no protections in the UK when you're a sex worker. So yeah, I I know that from that. But yeah, it's gonna take 18 months for them to even like summon you in court, which um starts really which really starts the process of going to court and getting a guilty or non not guilty verdict, but it's it's a long time, it really is, it's horrible. But I do truly believe they're not gonna frickin' act on this. It's already impacted porn in the UK, which we'll get into, but I don't think anybody is going to actually get taken a call for face sitting because I'll explain further on because with face sitting that is now classed as suffocation. Yeah, because you're restricting somebody's breath with your pussy. I mean you could say the same for deep throat videos as well, but yeah, we're gonna get into the porn side soon. Uh however, we consider that possessing an image will generally mean having custody or control of it. This could include where an image is stored on a device retained in a personal account or cloud, saved in files or otherwise kept physically or virtually. So you can't even, even if it's your partner, you can't have a picture, say, with your hand around their neck while you're fucking them, or a video. Consensually, bear in mind this is all consensual. Like this law doesn't say if a person's forced or anything like that. No, this is all even if it's consensual, this is like madness, consensual porn, even with your partner. You now can't have not even putting it online, you can't physically have it. It's ridiculous. You can't have a video of your partner sitting on your face, or your partner deep throat in your cock. You can't have that. Is a joke, it really is, and it's just so infuriating. How ridiculous the UK is getting. Oh man. So publish is defined in the offences to include giving or making an image available to another person by any means. This could include uploading, posting, sending, sharing, or distributing an image. So yeah, again, if you send your partner um the videos, the spicy videos that you made with each other, yeah, no, you're gonna jail. If they depict anything within this new stupid law. Uh so what we mean by strangulation and suffocation, the term strangulation is not defined in the legislation and will be given its ordinary meaning. Whether an image depicts strangulation will be a question of fact for the court in each case, we consider that strangulation generally means one person applying pressure to another person's neck. The term suffocation is not defined in the legislation and will be given its ordinary meaning. Whether an image depicts suffocation will be a question of fact for the court in each case. We consider that suffocation will generally mean depriving a person of air in a way that affects their ability to breathe. Unlike strangulation, this does not require pressure to the neck. It could, for example, involve covering someone's mouth and nose or compressing the chest. What you need to do before November 6. This was silly. Possession is a continuing act. If you already possess an image covered by these offences, you will need to permanently delete it or otherwise get rid of it before the 6th of November 2026 to avoid committing an offence once the offence comes into force. Publication can also be a continuing act if you have uploaded, posted or otherwise made an image covered by these offences available whether online or offline. You will need to remove it and stop making it available to others before the 6th of November 2026. So you just want sex workers who have worked for years to delete their content or sacrifice their lives, their livelihood, and leave it on there. But we're all like we are already sacrificing our lives by removing the content because we're not going to be able to make as much. Oh man, this is ridiculous. If you possess or are continuing to publish an image, it seems like so what I've figured out is it seems like only porn sites based in the UK fall under this ban. So I want clips sent out this morning to all their creators because I had to do like everybody is like so confused. So I want clips. So you have to remove just I want clips as a porn site. You have to remove choking fantasy play. Even though this is all consensual. Breath play fantasy, smothering, ass smothering, foot smothering, so I can't even put my fucking feet over your face. Breast smothering. You wanna be motivated? No. Squeeze smother, I don't actually know what that means, if I'm honest. Hand over mouth, face sitting uh BBW, so big beautiful women, face sitting, jeans, face sitting, so not even clothed face sitting. Um scissor hold, so wrestling fetish, chest sitting, throat busting fantasy, plastic fetish, I don't know, don't ask butt drops, ridiculous, and trampling fantasies. Now I don't know if this includes like just talking about it again. The law has not been that specific on things. So I don't know. I don't know. I would definitely suggest talking to a lawyer if you are in the UK about this. So there is a lovely lawyer in London who fights for UK sex worker porn anti-porn rights? Porn rights, yeah, not anti-porn. Porn rights. Um and he's really really good. He actually helped get the face sitting ban, which was in 2014. It was face-sitting and fisting overturned. So they already tried to ban face-sitting and fisting, which is crazy. So he put out a FetLife post. His FetLife is obscenity lawyer? Obscenity? Obscenity, that's the word. And um he says, I was consulted by the US Free Speech Coalition? Coalition to advise on this UK H-Play content ban FA and Q for platforms and creators. This FA and Q is general information to help you understand the UK's new ban on age play content. Not legal advice, it summarises what the law, the government's guidance, and other official sources say about the UK's new ban on content featuring adult role-playing as children as of October 2026. Every business and every piece of adult content is different, so please talk to a UK lawyer about your situation. The basics. Who does the law apply to? As we've discussed, anyone who possesses or publishes adult content in the UK, the law says it is illegal to possess or publish the targeted content. There's no exception based on who you are or why you have it. So it doesn't matter if you're a sex worker or not. Um it's weird because in some parts of detailing that I've seen, it says UK and other parts, like on the Gov website. It just says England and Wales. So I don't think going off of the government's own statement, it does not include Scotland. But uh I'm not the government. FSC cannot give legal advice, especially on such a vague law, but our impression is that individuals and companies located in the UK that create or publish choking content are at high at the highest risk. Companies not located in the UK that block UK users altogether or otherwise prevent UK users from accessing content prohibited under UK law would likely face lower risk. But we cannot stress enough how important it is to talk to a UK lawyer about the specific content before November 6th. Now if I'm honest, this guy is a lawyer and he's had to ask somebody else because he has no fucking idea. We nobody does. Not even our own government. It is so vague. If you are prosecuted, you may be able to argue in court that you had a legitimate reason for publishing it. So I'm looking at the free speech uh coalition, and apparently it does say my company is outside the UK, does this apply to me? And it just says yes. Like we have no fucking clue. Like just yes. Can a company be prosecuted or only individuals? The law makes a company criminally liable when a senior manager commits an offence within their authority. Can creators who appear in the content still sell it? No, the government memo says that offence bars a person who appeared in it, produced it, or directed it from publishing it to anyone other than the other persons who directly participated in the act, and that it directly targets those who publish images, including where they do so for commercial gain. So it's just fucking against sex workers. It's ridiculous. The law is so ridiculous. It's a criminal offence in the UK to possess or publish adult content that explicitly and realistically depicts sex between adults role-playing as children under 16. The government's guidance describes the age-play offence as covering sexual activity between at least two people where a reasonable person would think at least one person is or pretending to be under 16. So, like, we've already read that out, but this is all we've got to go off. This is all we've got to go off. Will Ofcom enforce this law? So Ofcom basically are in charge of all the laws, like overseeing it and editing them and things like that. The new law makes possession or publication of this content a priority offence under the Online Safety Act. We hear the Online Safety Act. Again, it's very anti-sex work. Ofcom says it will provide an update to our policy roadmap by the end of the year regarding new offences that make certain types of pornography content illegal. We anticipate this will involve a public consultation and lengthy drafting process. So it's not even fucking done. Not even done. And like to be a sex worker in this economy in the UK, it's pulling your hair out every day because the government has decided they want to do anti-sex work stuff and make new laws up, and it's just fucking ridiculous. So it literally is just like all the pictures like d it sounds like you have to be having sex in like age play attire. So is posting in a diaper okay? Dunno. Dunno. I guess we'll just have to wait until the end of the year. Cause like if I start reading loads of stuff and doing more research that I already have done, I'm just l we're literally just gonna be repeating ourselves. Because nobody has any idea. Cause I'm reading one person's statement, which they think they think because it's so it's so vague. So one person is saying many images are not pornographic when it comes to age play, adult baby diaper life, um, carer slash caregiver images. So they would not fall under the law because many images are not pornographic within the definition or do not depict sexual activity. Simple depictations of age play wearing childlike clothing, playing with toys, wearing diapers, etc., may well be sexually arousing for people with that kink, but they are not inherently sexual acts and are not pornographic. Even where an image does depict pornographic sexual activity, in most cases it would be quote fanciful that they are actually under 16 in the way pretended. For an offence to have occurred the honus is on the prosecution to show it was not fanciful, not for the defence to show that it was. So when it comes to fanciful, they're on about one specific thing where it says in the law. And then another person literally asks, What does fanciful mean? No one knows. No one knows. The law doesn't define it, and the government hasn't said how it will be decided. A government uh member gives two examples of content that isn't meant to be covered. An adult dresses in a nappy and pretends to be a baby, someone who is clearly an adult where the only marker of childhood is the fact that he or she is in a school uniform. Baroness Burton, who spearheaded the law, told Parliament that exclusion covers generally fanciful depictions involving unambibiculously adult participants whatever the fuck that means. So that's where everyone's saying fanciful because of this baroness woman. Is teen or schoolgirl content covered? Maybe. The government's equally the government's ignore that bit. The government's equality assessment names teen and schoolgirl categories as popular and says they predominantly depicts women portrayed as young girls. But the government has also said a school uniform alone on someone who is clearly an adult isn't meant to be enough. This is ridiculous. Do titles, tags, and descriptions matter? The law tests the laws test takes into account any sound or information associated with the image. For possession associated material in the possession, for publication material the publisher publishes with the image. Titles, tags, dialogues, descriptions, and categories probably all count as associated information. That's not explicitly spelled out in the law. Does AI generated content count? Yes, if it's realistic. The guidance says that offence only capture pornography that shows people which appear to a reasonable person to be real. Possession, publication, and existing content. What does publish mean? The law defines publishing a piece of content as giving or making it image making it image available to another person by any means. Government guidance says that publishing could include uploading, posting, and blah blah blah blah with what we've said. Um I'll be honest, if the government wants to screw you over, they will fucking screw you over. If cops want to twist it, they will try and twist it. Judges will be judges. It's so stupid. So I publish all my stuff on a website called Scat Book, and I think they are located in Spain or somewhere like that. I'm actually not too sure. Let me look. Okay, it's actually located in the United States. I haven't heard anything pop up on my feed about it yet. It's gonna suck. It's gonna suck so bad if they say that I can't post a lot of my content on there. Cause as I said, the UK-based I want clips have, you know, said you can't have all that on there. It's I really hope this gets overturned. A film board may soon be auditing online adult content online, which is what is happening. Like, all I wanna do is film hot sexy porn. Like, why is it so hard to ask? So yeah, in 2014, a change was made to the 2003 Communications Act, which affected porn in the UK. It banned the list of sex acts by demanding paid for video on demand. Online porn is regulated by the same guidelines set out by the British Board of Film Censors, BBFC, that DVD pornography must stick to. Free banned acts were deemed life-threatening, so strangulation, face-sitting, and fisting. Abusive language during sex was also banned alongside depictations of non-consensual sex. Yeah, so abusive language during sex was then also banned. So that was overturned the 2014 one, and there was actually quite a few protests about that as well. I just really it's so vague and it's so ridiculous. So I was researching it as well, so I had a photographer. Uh I saw one of their statements and it said video editor's uh statement was as of November 6, 2026, new laws prohibit strangulation and suffocation pornographic material from being created, possessed, and distributed take effect. While I haven't been sent any footage depicting these acts, in a typical sense, hands around the neck to be edited. The new laws will regard anything where pressure is applied to the neck as strangulation, and anything that restricts the airways as suffocation. So this can be anything from a foot lightly pressing on someone's neck to a hand covering someone's mouth and nose. For obvious reasons I cannot receive any footage to edit that contains this past November 5th. From now until November 5th, such as such footage will be cut from the final edit. From November 6th onwards, discovery of any footage will not be sent or edited. Like that's fucking insane. And I'm seeing clients, punters, people who watch porn, men mainly, say they're gonna get around this ban by using VPNs, and they do as well think this law is ridiculous. And everybody is asking, like, are they gonna ban Game of Thrones? Are they gonna ban like Vikings? Are they gonna ban TV programs and movies? What about the educators who are educating us about like age play or strangulation? Like it's like you can you can't strangle somebody in a safe way. There like BDSM is never never safe. But you can put things in place to make sure things are safely being done. Like when it comes to sex workers, we all have to band together and talk about this because people aren't gonna know in the sex work industry. We're not gonna get taught, nobody's gonna get taught about this. It's fucking it's a joke. It honestly is. Yeah. This is uh the end of the episode. I think I have uh spoken quite a bit.
